  Just start the proceedings to replace him, assume bad faith and move on without the idiots. If he wants to keep his seat he’ll show up

    I agree. If he’s alive, he’ll find a way to stop Beshear from replacing him!

    The most pragmatic (and generous) move would be to say that it is an interim replacement.
