As a result, employers could potentially rush to federal court to obtain injunctions against ongoing board trials, preventing board members from issuing decisions. Furthermore, employers may seek restitution from employees who have previously received NLRB awards, as the agency’s adjudication powers would be deemed unconstitutional.
