  Only because the state cannot (demonstrably so) execute justice in a just and equitable manner. Frankly, it’d be fucking dumb to be against the death penalty if (IF) the state could guarantee that the correct person is correctly judged for the correct offense.

  Of course that reality is a loooong ways away from this reality, so… death penalty remains a path for the state to unjustly murder innocents. Though IMO, locking innocent people up for the majority of their life is still a gross misjustice akin to the death penalty being execute on an innocent person, but baby steps I guess.
