Or another way to ask the same thing: “Do you mind taking all the legal risk so that I could save some money?”

I’ve met more than a few businesses that will give a discount for cash.

Cash discounts aren’t about it being ‘off the books’, however. That is because cash doesn’t incur a credit card fee, and they are passing the savings to you.
