It would still be an issue because (a) Kentuckians are missing half of their Senate representation, and (b) because his death is obviously being hidden for bad faith political purposes, to illegally deprive Kentucky’s governor of his right to appoint a replacement.

Except that most people in most countries are retired by age 75 and therefore wouldn’t be “off” on sick leave in the first place.
