As libertarians, we say that a breach of contract is justification for force. That said, are there any limits to what contracts can do? One example is non-compete clauses. These are contracts between laborers and employers that harm labor mobility. Should they be enforced in a free society? There are also other things like possible contracts not allowing an employee to share a company’s secrets after they become unemployed. Should this contract be enforced?
What are the limits of contracts, if any?
