My 105lb, 5'1 pregnant asian wife was t-boned in an intersection yesterday by a 300lb, angry and heavily medicated black woman.
The entire thing is on dash cam. This land whale blew a stop sign and nearly killed my wife. Miraculously my wife is fine and the car isn't totaled. However, on the scene (which I wasn't at) this woman unleashed an angry, accusing tirade on my terrified wife (first major accident). The aggressive driver had no insurance card (illegal in my state) so wife asks to take a pic of the app on her phone. She wouldn't prove it. My wife called the police.
Officers arrive and the firs thing they do is collect insurance, registration and get comment from my wife. Talked to her for about 3 mins. The they then proceeded to talk to the other woman and, apparently, didn't ask them to provide proof of coverage. This officer said since this accident was on "private property" he could not issue any citations and had no jurisdiction. This is because they pulled over into a parking lot next to the intersection the accident happened in. Even though the accident itself was on a public road...what? I have been pulled numerous times and, even for simple traffic stops, the first thing any cop has ever said to me is "license and registration", even if I have to pull over onto private commercial property.
So my insurance can't confirm which insurance company to go after because 1) this woman has a common first/last name, 2) provided the officer with a fake insurance company name (progressive but they cant find her in database) and no policy #.
My hunch is she is un-insured. My insurance company is in the process of hunting her down but it's like a needle in a haystack so I may need to go to small claims court; especially since when I called the police officer who response to the scene he essentially said I should go fuck myself. "private property property, no jurisdiction". I wasn't even asking him to cite her, just that he collect her insurance information properly (like he did with my wife) and make sure an un-insured motorist isn't fucking around on the roads. My other hunch is that this white cop was told by his boss to check his privilege and be ethnically sensitive out there on the streets.
Anyways just wanted to share this story. Makes an interesting case for roadways and insurance situations in AnCap I suppose.
