I was on a long car ride with my dad on our way to a long hike and I was trying to yet again convince him (he's a retired Republican state politician) about anarcho-capitalism.
The topic was private law. He started asking the typical questions about wouldn't the DROs just turn into private armies, etc.
We eventually got past that into a hypothetical discussing how a private law company would address loss to a spouse or parent if a spouse or child were murdered.
I believed intuitively that the survivor had experienced some kind of violation, but I couldn't think about what core right was being violated in order for the survivor to have a legitimate claim.
For spouses, contract law would probably solve most of that. A marriage contract might stipulate a combining of assets, resources, and income, and murder interferes with that, though I hope there's a better way of looking at it than that.
I'm pretty much stumped when it comes to kids though. What violation am I actually experiencing if someone were to murder one of my kids? What right is violated?
