can infecting others with deadly disease be considered violation of NAP?

Say you had Ebola, and you know. You manage to walk outside and decided to spit everywhere. Can we say this person is committing attempted murder?

How true would it be if we change it to COVID or flu? Where chance is 100x smaller?

But causing people to hospitalization or discomfort is still a form of NAP?

Is it just a matter of practicality that we treat whether an action is violation of NAP or not?
