You’d probably say of course not, air is immaterial, so you can’t own it.
But what would you say if a drone flies 10 feet above the ground over your property, filming the inside of your house? If it’s not touching anything solid on your property, what’s the difference between the drone and a helicopter 1,000 feet above your house, besides elevation? If you can justify destroying the drone, you can justify destroying the helicopter.
That also brings up the opposite question, do you own the ground beneath your land? You obviously do, because otherwise you wouldn’t be able to farm, let alone dig a hole on your property. So how far down do you own? If you can justify owning a foot below the surface, why not 10,000? Why not all the way from your property to the point directly opposite your property on the other side of the planet (antipode)?
Could I dig a tunnel from my property underneath someone else’s property, and build an underground fort?
