this whole topic is problematic, as let's say they were doing research to create bioweapons or understand how they work so they could defend against them
this research may look indistinguishable from developing "offensive" bioweapons
but then also why can't private groups do research in this way to protect against such weapons? but then if we allow more of that, there's a danger of a proliferation of such weapons

2nd amendment is to defend your rights, not set off nukes to wipe off the country. Unfortunately a bioweapon kills like a nuke.
Joe makes a virus for fun/by accident, (or Joe is a depressive suicidal psychopath). 95% of humans are gone. That's possible given how easy it is to get the tools (I worked in labs on skin diseases and cancer). Even if govt bans it, people can read papers and moonshine.
The difficulty is figuring out what virus to make. The Chinese took harmless bat viruses from Laos and made them infect human lungs - Covid19. Private companies like Pfizer made gene therapies... I mean vaccines that destroy hearts, ovaries and nerves of kids with govt sponsorship.
Can we use Bio Nukes for good ? Yes, with a lot of care, not like Pfizer, you can cure diseases like cancer, cystic fibrosis etc. But don't use on enemies. The world will end.
