If Capital one already reported it as fraud, what’s the problem? You shouldn’t need to prove it’s fraud, the business should need to prove it’s valid based on what I’ve experienced before. That’s their problem, not yours.

They just sent an alert to me that they added 100% tip, not that it’s fraud. So I called them, and restaurant can’t even give me any receipt and never did.

So do a chargeback with the credit card company, tell them it was in fact fraud.
